Ref MTCE 2022: Civil Enforcement Area for Moving Traffic Contraventions – Horseshoe Common

In February 2023, BCP Council submitted an application to the Department for Transport to obtain a Designation Order as a civil enforcement area for moving traffic contraventions. If approved by Parliament, this would give the council new powers to tackle unlawful vehicle use.

The application will:

  • initially be for enforcing a single Traffic Regulation Order (TRO) near the southern end of Horseshoe Common where non-compliance is particularly acute

  • also request that powers be made available across the entire BCP area so that enforcement options for other locations can be considered in future subject to further consultations.

As part of this application, the council undertook a six-week public consultation from 16 December 2022. This provided an opportunity for the public to make representation on:

  • our proposals for enforcing the TRO near Horseshoe Common

  • our proposals for enforcing other TROs in the BCP area

  • communication of enforcement

  • methods of enforcement

  • alternative ideas and suggestions.

Interested parties were invited to make comment in writing by either:

  • emailing traffic@bcpcouncil.gov.uk or

  • posting a letter to Traffic Team, BCP Civic Centre, Bourne Avenue, Bournemouth, BH2 6DY.

The highway consultation reference was MTCE 2022.

On 27 June 2023, the Department for Transport laid before Parliament the Civil Enforcement of Moving Traffic Contraventions Designation Order 2023 Statutory Instrument (SI 2023/698). A link to this is provided on the right-hand side of this page.

SI 2023/698 is scheduled to come into force as law on 22 July 2023, subject to no objections from Parliament. The objection period for Parliament is scheduled to end on 14 September 2023.
